Compensation Law

Two questions decide compensation files: whose fault caused the loss, and how the monetary value of that loss is calculated. The second often requires more work than the first; the real figure emerges only once actuarial calculation, life expectancy tables and the ratio of fault come together.

Traffic accidents Loss of support and permanent incapacity compensation in fatal and injury accidents, vehicle depreciation, applications to insurers and proceedings before the Insurance Arbitration Commission.

Occupational accidents and diseases Determination of fault and disability ratios, pecuniary and non-pecuniary damages, recourse actions.

Medical malpractice Liability of physicians and healthcare institutions, assessment of expert and forensic medicine reports.

Other torts Non-pecuniary damages for infringement of personality rights, insult and defamation; damage to property.

Limitation periods Claims arising from tort must be brought within two years of learning of the damage and the tortfeasor, and in any event within ten years. Where the act also constitutes a criminal offence, the criminal limitation period applies.
